General Terms and Conditions of Sale

1. Scope of application

This online shop is operated by Vignes et Domaines Sother SA, Malessert 4, 1166 Perroy. These General Terms and Conditions of Sale (hereinafter “GTCS”) shall apply to all contracts concluded between you as customer (hereinafter “you, your”) and us as operators of the online shop at (hereinafter “we, our”). When placing an order, you acknowledge the GTCS in the version current at the time of placing the order. All oral or telephone agreements must be confirmed in writing for them to be binding. This requirement can also be met by a statement contained in an email.

2. Compatibility

The way products are represented in the online shop is not legally binding and merely constitutes a non-binding online catalogue. Simply adding products to your “basket” does not constitute a binding order. These products will not be considered to be a binding order until you click on the “Checkout” button on the order page. Successful receipt of this order will be immediately confirmed by automatic email and this forms a contractual agreement. Consent is given subject to the legal admissibility and availability of the goods ordered. If we are unable to fulfil your order, you will be notified of any unavailability. Where availability is stated in the shop, this is for information purposes only and is not confirmation of delivery as it may be incorrect. Variations may result in a change in prices. The final price shall be that listed at the time the order is placed. A maximum of one customer account shall be permitted per household/company unless expressly requested and authorised by mutual written consent.

3. Delivery and delivery charges

We will deliver the goods you have ordered as soon as possible. Once the order has been recorded, you will receive an initial order confirmation via email. You can track your shipment at any time via “Track & Trace”. This enables you to know the status of your delivery at all times. Prior to a delivery being attempted, you can easily and flexibly change the conditions via your computer or smartphone. For example, you can change the recipient’s address so that your parcel is delivered somewhere else (your office, a neighbour or your holiday home). You can also select a specific time slot at an additional cost. For all deliveries, the price stated includes value added tax applicable at that time.

4. Due date and payment

We only accept the payment methods specified in the order procedure. Purchase price and delivery costs are valid from the moment the contract is concluded.

5. Warranty and liability

If the goods are delivered incomplete or damaged, for example, there is a product defect or delivery error, we will ensure that this is remedied. If possible, this will be with a replacement delivery, otherwise we will refund the missing or damaged goods. Our liability for our own errors, as well as those of our employees and agents, shall be limited to the above statement.

7. Data protection

We use the data you provide to us for the purposes of processing your order. Your data is forwarded to the shipping company responsible for delivery insofar as this is necessary for delivery of the goods. In order to process payment transactions, we forward your payment data to the financial or credit institution responsible for your payment. We do not forward your data to third parties for marketing purposes. Once the order and payment are complete, this data will be blocked until you use it again, and will be deleted on expiry of the data retention periods given for commercial and tax law purposes, if you have explicitly opted for your data not to be used. We protect our website from loss, destruction, access, alteration and distribution of your data. Despite frequent checks, we cannot protect ourselves from all risks. In accordance with the Federal Data Protection Act (DPA), you have the right to obtain information on the data held on you free of charge at any time and you have the right to correct, block or delete that data. Marketing via email (Newsletter)
If you sign up to our newsletter, we use the data required for this purpose to regularly send you our newsletter by email. You can unsubscribe from the newsletter at any time via the link provided in the newsletter. We may also use your newsletter subscription for remarketing purposes on social media such as Facebook, etc.

Credit review and credit score
Insofar as Vignes et Domaines Sother SA is required to provide an upstream service (i.e. payment on account), we reserve the right to request information on identity and creditworthiness from service companies specialising in this area (business intelligence agencies). We therefore forward the personal data required for a credit check to the company responsible. The credit check may include probability values (score values), which are calculated on the basis of scientifically-recognised mathematical/statistical procedures and which, in particular, include address data in their calculations. We use the information received on the likelihood of default to make a documented decision regarding the creation, implementation or termination of a contractual relationship. This may mean that we can no longer offer you certain payment options.

8. Customer reviews

We shall have the right to exclusive and unlimited use of all comments written about our products on our website. We reserve the right to display a review for a limited period only, in a truncated form, or not at all. A customer review is only a customer's opinion and does not necessarily correspond to our view of things.

9. Alcoholic beverages

Alcoholic beverages shall not be sold to children under the age of 18. During the order process, customers must confirm that they are 18 years of age or older. No contract will be issued if this minimum age is not met. Customers are required to make truthful declarations. Vignes et Domaines Sother SA reserves the right to require a copy of a person’s identity card without reason.

10. Competent court

Our business activities shall be governed exclusively by Swiss law. If any particular provisions of the contract become ineffective, this shall not result in the ineffectiveness of the whole contract. The parties choose the Nyon Court as their place of jurisdiction.
